1. Discription of services provided by WOWz STAYs

 

WOWz STAYs serves as an online as well offline platform that offers an convenient mechanism for only locating hotels and stays. WOWz STAYs also hosts content provided by and on behalf of the hotels and stays such as general information about the hotels and accommodation, photographs, amenities, etc. You understand that WOWz STAYs is only a facilitator in helping the customers locating suitable hotels and stays and not the owner or lease holder of the Hotel or stays. Thus WOWz STAYs shall not be responsible or liable for any deficiency of service, lack of amenities at the Hotel, stay  or if the Hotel posted on our Booking Channels do not match in real as shown in the photographs on the Booking Channels or on the website of the Hotel or stays.

 

It is hereby further clarified that Hotel(s) stay(s) owners are separate and independent entities and WOWz STAYs does not work as representative or agent of the Hotel(s)/ stays(s) or its owner(s).

 

It is hereby further clarified that certain Hotel do not allow pets in the Hotel premises. Moreover some Hotel(s)may deny entry of visitors to rooms. Please confirm about such queries with the concerned Hotel before making the booking/ reservation.

 

By making a reservation/booking at the listed Hotel(s)/ stay(s) the Guests enters into commercial/ contractual terms as offered by and agreed to between Hotel(s)/ Stay(s) and the Guest alone.

 

WOWz STAYs does not implicitly or explicitly support or endorse any of the Hotel(s)/ Stays(s) listed on our Booking Channels. WOWz STAYs accepts no liability for any errors or omissions on behalf of third parties.

 

Guests shall understand that in some Hotel(s), due to local conditions, unmarried/unrelated couples are not allow to book room or Check-In the Hotel(s). Hotel(s) can deny entry to the Guests posing as a couple if suitable proof of identification is not presented at the time of Check-In. Wowz STAYs in no circumstance shall be responsible for any claim in such denial.

 

All the information pertaining to the hotel including the category of the hotel, images, room type, amenities and facilities available at the hotel are as per the information provided by the hotel to WOWz STAYs. This information is for reference only. Any discrepancy that may exist between the website pictures and actual settings of the hotel shall be raised by the User with the hotel directly, and shall be resolved between the User and hotel. WOWz STAYs will have no responsibility in that process of resolution, and shall not take any liability for such discrepancies.

 

2. Terms & information from the Hotel(s)

 

The hotel booking voucher which WOWz STAYs issues to a User is solely based on the information provided or updated by the hotel regarding the inventory availability. In no circumstances can WOWz STAYs be held liable for failure on part of a hotel to accommodate the user with a confirmed booking, the standard of service or any insufficiency in the services, or any other service related issues at the hotel. The liability of WOWz STAYs in case of denial of check-in by a hotel for any reason what-so-ever including over-booking, system or technical errors, or unavailability of rooms etc., will be limited to either providing a similar alternate accommodation at the discretion of WOWz STAYs (subject to availability at that time), or refunding the booking amount (to the extent paid) to the user. Any other service related issues should be directly resolved by the user with the hotel.

 

Hotels reserves the sole right of admission and WOWz STAYs has no say whatsoever in admission or denial for admission by the hotel. Unmarried or unrelated couples may not be allowed to check-in by some hotels as per their policies. Similarly, accommodation may be denied to guests posing as a couple if suitable proof of identification is not presented at the time check-in. Some hotels may also not allow local residents to check-in as guests. WOWz STAYs will not be responsible for any check-in denied by the hotel due to the aforesaid reasons or any other reason not under the control of WOWz STAYs. No refund would be applicable in case the hotel denies check-in under such circumstances.

 

3. Listing terms for Hotel

 

The Hotel(s)/ stay(s) listing their properties understand and agree that:

 

A). All reservations that are made through our Booking Channels are a contract between the individuals and the Hotel(s)/ stay(s); WOWz STAYs is in no way responsible or liable for the transactions made between individuals and Hotel(s)/ stay(s);

 

B). Hotels are solely responsible for accurately describing their properties being listed along with services and amenities that they are providing along with the accommodation;

 

C).WOWz STAYs reserves and retains the right to suspend or stop the listing of any Hotel(s)/ stay(s) at any point of time for any contravention of the Terms and Conditions and / or for any breach of the terms agreed to by the Hotel(s)/ Stay(s) at the time of listing with WOWz STAYs without prior notice.

 

4. Booking terms for Users

 

The Hotel(s)/ Stay(s), and NOT WOWz STAYs , are solely responsible for honouring any confirmed bookings and making available any Hotel(s)/ Stay(s) reserved through the Booking Channels. If you choose to enter into a transaction with any Hotel(s)/ Stay(s), you agree and understand that you will be required to enter into an agreement with the said Hotel/ stay, you agree to accept any terms, conditions, rules and restrictions associated with such Hotel(s)/ Stay(s) imposed by the Hotel(s)/ Stay(s). You acknowledge and agree that you, and not WOWz STAYs, will be responsible for performing the obligations of any such agreements, and WOWz STAYs is not a party to such agreements and disclaims all liability arising from or related to any such agreements. WOWz STAYs is not responsible for any non-performance or breach of any contract entered into between you and the Hotel(s)/ Stay(s). WOWz STAYs cannot and does not guarantee that the Hotel(s)/ Stay(s) will perform any transactions concluded on the Online Booking Channels.

 

5. Booking Confirmation

 

Once Booking is Confirmed, WOWz STAYs shall issue  “Booking Confirmation” intimation to Guests, which entitles Guest to Check-In subject Property on the dates of Booking. Guests will not be permitted to Check-In the Property unless a Booking Confirmation is issued to Guests by WOWz STAYs and Guests produces the same at the time of Check-In.

 

The primary guest must be at least 18 years old to be able to check into the hotel.

 

The User has to be in possession of a valid identity proof and address proof, at the time of check-in. The hotel shall be within its rights to deny check-in to a user if a valid identity proof is not presented at the time of check-in.

 

Check-in time, check-out time, and any changes in those timings, will be as per hotel policy & terms. Early check-in or late check-out request is subject to availability and the hotel may charge an additional fee for providing such services.

 

6. Check In and Check Out

 

You as a Guest understand that the Check In and Check Out time of each Booking made at any Hotel(s)/ Stay(s) shall be as per the policy of the concerned Hotel(s)/ Stay(s) and not as per the policy of WOWz STAYs

 

7. Cancellation Policy

 

By making a reservation with a Hotel, you accept and agree to the relevant cancellation, refund and no-show policy of that Hotel, and to any additional (delivery) terms and conditions of the Hotel that may apply to your reservation or during your stay, including for services rendered and/or products offered by the Hotel.The general cancellation, refund and no-show policy of each Hotel may be made available on our Online Booking Channels on the information pages of the Hotel , during the reservation procedure and in the confirmation email or in brochures in case booking is made through Offline Booking Channels. Please note that certain rates or special offers are not eligible for cancellation, refund or change. Please check the room details thoroughly for any such conditions prior to making your reservation. Late payment, wrong bank, debit or credit card details, invalid credit/debit cards or insufficient funds are for your own risk and account and you shall not be entitled to any refund of any (non-refundable) prepaid amount unless the Hotel agrees or allows otherwise under its (pre)payment and cancellation policy.

 

If you wish to review, adjust or cancel your reservation, please revert to the confirmation email or in brochure of the hotel and follow the instructions therein. Please note that you may be charged for your cancellation in accordance with the Hotels cancellation, (pre)payment and no-show policy or not be entitled to any repayment of any (pre)paid amount. We recommend that you read the cancellation, (pre)payment and no-show policy of the Hotel carefully prior to making your reservation and remember to make further payments on time as may be required for the relevant reservation.

 

8. Additional charges by Hotel

 

The booking amount paid by the User is only for stay at the hotel. Some bookings may include breakfast and/ or meals as confirmed at the time of booking. Any other services utilized by the User at the hotel, including laundry, room service, internet, telephone, extra food, drinks, beverages etc. shall be paid by the User directly to the hotel.

 

Hotels may charge a mandatory meal surcharge on festive periods like Christmas, New Year's Eve or other festivals as decided by the hotel. All additional charges (including mandatory meal surcharges) need to be cleared directly at the hotel. WOWz STAYs will have no control over waiving the same.

 

9. Booking payments and any additional payments

 

Booking of a hotel can either be "Prepaid", or "Pay at hotel" as per the options made available by a hotel on the WOWz STAYs Website.

 

In "Prepaid" model, the total booking amount is paid by the User at the time of booking itself. Such total booking amount includes the hotel reservation rate, taxes, service fees as may be charged on behalf of the actual service provider, and any additional booking fee or convenience fee charged by WOWz STAYs.

 

At the hotel's or WOWz STAYs sole discretion on case to case basis, the User may also be provided with an option to make a part payment to WOWz STAYs at the time of confirmation of a booking. The balance booking amount shall be paid as per the terms of the bookings. For security purposes, the User must provide WOWz STAYs with correct credit or debit card details. WOWz STAYs may cancel the booking at its sole discretion in case such bank or credit card details as provided by the User are found incorrect.

 

Payment can be made in INR only.

 

Some banks and card issuing companies charge their account holders a transaction fee when the card issuer and the merchant location (as defined by the card brand, e.g. Visa, MasterCard, American Express) are in different countries. If a user has any questions about the fees or any exchange rate applied, they may contact their bank or the card issuing company through which payment was made.

 

Some accommodation suppliers may require user and/or the other persons, on behalf of whom the booking is made, to present a credit card or cash deposit upon check-in to cover additional expenses that may be incurred during their stay. Such deposit is unrelated to any payment received by WOWz STAYs and solely at the behest of the Hotel.

 

In "Pay at hotel" model, the concerned hotel will collect the entire payment against the booking at the time of check-in.For security purposes, the user must provide WOWz STAYs with correct credit or debit card details. WOWz STAYs may cancel the booking at its sole discretion in case such bank or credit card details as provided by the user are found incorrect.

 

10. Damage to the property of Hotel

 

As a Guest, you are accountable for parting the Hotel in the condition it was in when you arrived. You are liable for your own acts and omissions and are also responsible for the acts and omissions of any individuals whom you invite to, or otherwise provide right of entry to Hotel.

 

Guests understands and agrees that if a Hotel claims and provides evidence that you as a Guest have damaged the Hotels or any personal or other property at the Hotel, the management of the Hotel can escalate such a damage claim to us or directly to you. The Guests shall co-operate and provide correct and true information to the Hotel in case of such circumstances. In case you don’t co-operate or provide the required information regarding the damage claim, the Hotel shall be free to take appropriate legal action against you.

 

WOWz STAYs shall not in any way be responsible and shall not act as a mediator or help in resolving any dispute or disagreement between Guest and the Hotel. In no event, shall WOWz STAYs be made a party to dispute between Guests and Hotel.
